High Court’s order regarding dead man’s sperm
The Delhi High Court surprised everyone with a shocking decision on Friday. The High Court ordered Sir Gangaram Hospital in Delhi to give the frozen sperm of a dead man to his parents for the birth of a child. The High Court said that there is no restriction in Indian law on having a child after death. Justice Pratibha M Singh gave this decision on the appeal of the father of the deceased man. The father of the deceased wanted that his son’s sperm be given to him so that he can see his lineage going forward. The judge said that after the death of the parents, many grandparents are raising their grandchildren and this is a common thing.
Asked to hand over frozen sperm to family
In November 2022, the High Court had issued a notice to the Ministry of Health and Family Welfare, seeking a response on a petition seeking release of the deceased person’s sperm from the hospital, which was filed by the parents of the deceased. In the petition, the deceased had said that the frozen sperm of his son kept in the in vitro fertilization lab at Sir Ganga Ram Hospital, who died of cancer in 2020, should be released. The parents contacted the hospital but the hospital refused, saying that they have no government orders to release it, and they can release it only on the order of the court.
Government asked to intervene in the matter
Earlier, the court had issued a notice to the Delhi government and Ganga Ram Hospital and sought a reply. According to ANI, the Delhi High Court directed Sir Ganga Ram Hospital to give the frozen sperm of a deceased person to his parents for surrogacy. The High Court said that there is no law regarding not releasing the frozen sperm and it was also said that the ICMR guidelines and the Surrogacy Act are also silent on this issue. The court said that the government’s attitude towards this decision is very important.
